Lee Hutton Victory in Land Dispute Case

Lommen Abdo Litigator Lee Hutton recently obtained two trial victories in Roers v. Robert Hare, Michael Pierce and Real Estate Nexus and Roers v. Michael Pierce.

The first Roers trial involved a land dispute over 65 acres that allegedly were not sold to the Roers when it purchased a tract of property. The claims involved negligent misrepresentation, fraudulent misrepresentation, breach of fiduciary duty, and breach of contract. Lee Hutton obtained a $522,000.00 judgment against the Defendants collectively in a bench trial before Judge Zimmerman.

Lee Hutton and Lommen Abdo Associate Nick Dolejsi tried the second part of the Roers’ real estate action against Defendant Michael Pierce. The issue in that case arose out of a seller’s duty to disclose water intrusion and other defects known to the seller at the property sale. The jury found negligent misrepresentation and violation of Minn. Stat. §513.55 which obligates a seller to disclose material facts to a buyer. Mr. Hutton and Mr. Dolejsi tried this six-day trial before a Hennepin County jury, obtaining a $732,250.00 verdict.
