Lommen Abdo has an established, successful creditors’ rights practice and our experienced and aggressive litigators provide comprehensive handling of all matters. We litigate creditors’ rights actions in both state and federal courts and often obtain recoveries in situations other law firms find futile.
Our attorneys are well-versed in representing creditors in bankruptcy in Courts throughout the United States. We actively protect our clients’ rights as secured or unsecured creditors in bankruptcy through an active motions practice, including motions for relief from the automatic stay, to compel administrative payment and claims resolutions. We also have considerable experience in the defense or prosecution of preference actions, avoidance actions and other adversary proceedings. We currently represent four Fortune 500 companies as their national bankruptcy counsel by utilizing, when necessary, local counsel hand-picked for their expertise and reputation. Our centralized national preference practice enables our clients to achieve significant savings on attorneys’ fees, because we act as primary counsel and negotiate and prepare all pleadings to be filed in each jurisdiction at our Midwest hourly rate, which is often significantly lower than most of the most active bankruptcy jurisdictions. Using a centralized system for preference actions allows us to get to know and understand the work of our clients so that we can help them track and create the records needed. It also allows us to re-utilize arguments tailored for each jurisdiction – all reducing the ultimate cost to our clients.
Where the need arises, our Creditors’ Rights attorneys can enlist the help of corporate attorneys, tax attorneys, employment attorneys, commercial litigators or others in the firm whose area of expertise may help hasten the resolution of a collection lawsuit. In addition, as noted above in the bankruptcy context, the firm works with a network of local counsel throughout the United States, enabling Lommen Abdo to effectively represent creditors in most, if not all, United States jurisdictions.
The Creditors’ Rights Section of Lommen, Abdo, Cole, King & Stageberg, P.A. includes Margie Bodas and Deb Swenson. In addition, Brent Johnson provides creditor representation in Wisconsin.

Lommen Abdo’s collections clients include transportation companies, leasing entities, staffing agencies, title and other insurance companies, financial institutions, nursing homes, collection agencies and other commercial clients. (References from clients are available upon request.) A sub-specialty within the creditors’ rights practice area is the collection of workers’ compensation insurance premiums. Our firm’s experience in defending employers and insurers in the workers’ compensation system, as well as providing coverage representation to insurers relating to workers’ compensation issues, provides a strong foundation for the collection of delinquent premiums. Our section understands the audit process, the classification disputes, payroll distribution, independent contractor issues and the other elements essential to successfully resolving past due premium accounts.

The law firm is highly automated and efficient. E-mail communications and billing can easily be arranged for any interested clients. Lommen Abdo’s efficiency allows the Creditors’ Rights Section to bill at very reasonable rates. The firm offers flexible billing programs to meet any need, including volume discounts. The section recognizes that different clients have different goals or needs to be met with their collection programs. The section works with clients to develop fee structures that share risk, enhance predictability of cost, or otherwise make the collection program profitable for both the client and the firm.
The mission of Lommen Abdo’s Creditors’ Rights Section is to provide outstanding value to our clients by providing top quality legal services at reasonable rates. To further that mission, we offer collection programs that maximize the unique advantages that we have to offer.
