Electronic Litigator® - Managing the Litigation Life Cycle with Technology

Introducing Electronic Litigator®

Electronic Litigator®, a wholly-owned subsidiary of Lommen Abdo, assists with the digital management of each phase of a litigation matter, from initial discovery through trial. Electronic Litigator® services are available both to Lommen Abdo clients and outside businesses. Electronic Litigator® utilizes its powerful technology assets to provide thorough yet efficient document analysis for both paper and electronic documents and maximizes their presentation in litigation. It is a cost-effective one-stop shop for litigation technology services.

Electronic Litigator® consists of a suite of four computerized litigation support services (Law, Summation and Trial Director). They each can be utilized separately or in conjunction with one another. As the litigation life cycle begins with discovery, Electronic Litigator® first enters this world with Law.

LAW 5.0

Law inventories, culls and extracts information both from scanned paper documents and from electronic records. This means it will actually take data from the electronic discovery, de-duplicate email strings so it shows the entire string in one email rather than in multiple emails. Law has image enhancement capabilities (such as straightening a crooked scan, removing scatter from a scan, etc.) along with the ability to match existing bates numbers or create bates numbers and burn them to document images.

Law then uses Optical Character Recognition (OCR) to convert the documents into searchable text, which vastly decreases the time spent searching for specific documents or subject references in boxes of documents.

When Law has finished the above processes, it creates a computer file containing both the documents and all of the enhancements which can be loaded into Lommen Abdo's standard service programs, Summation and Trial Director, as well as into programs used by other firms such as Concordance, Sanction, etc.

E-Discovery Processing

Electronic discovery consists of the collection, preparation, review and dissemination of electronically stored information, including emails, word processing files (Word, WordPerfect), data management files (Excel), photographs, PDFs, network databases, metadata, and other information that is stored electronically. The collection, recovery, and analysis of these types of electronically stored information is integral to litigation in an increasing digital age. Fortunately, Electronic Litigator is well-equipped to customize its discovery methodologies and increase your legal team's efficiency. Electronic Litigator can recover and process over 100 different types of electronic files, deduplicate collected electronic discovery, extract important metadata, complete OCR and Tiff processing. Electronic Litigator can also create load files for Summation and other databases or provide scanning services to meet your specific e-discovery needs. Electronic Litigator is your experienced and comprehensive partner in electronic discovery.

Summation

Summation is a database program specially designed to provide integrated litigation support. Summation provides a single location for organizing a wide variety of case information including deposition transcripts and exhibits and physical documents produced in discovery, as well as documents produced electronically - including e-mail.

Summation's Case Explorer provides document and deposition search and retrieval, allows for the creation and editing of summaries (you can type your notes right into the database rather than on post-it notes or yellow pads and these notes will always remain linked with a certain document), allows the marking and highlighting of important documents, links witnesses to specific documents, and can even create trial witness lists and exhibit lists.

Electronic Litigator® will customize your Summation database to meet the needs of your particular case. For example, we can track which experts have received which documents and add an issue field that will note if the document relates to calibration, misuse, etc.

Trial Director

Trial Director is a trial presentation program, run on a laptop in the courtroom. It can display exhibits, photographs and video clips on either computer monitors set up for the court and jury, or project these images on a video screen. Portions of exhibits can be highlighted in real-time before the jury and witnesses. Trial Director can also zoom in on portions of an exhibit, display exhibits with confidential or irrelevant sections redacted or display only a specific part of an exhibit, such as the most important paragraph of a document. Trial Director can even synch a video deposition with the deposition transcript, and display both simultaneously - making it easy for a jury to follow even the most complex testimony. Trial Director is a solid presentation that can improve your outcome in trial.

Phil Cole has found Trial Director's document and video presentation program to be valuable in the trial of document intensive cases. Phil gives three reasons why he feels Trial Director is a key component for a trial lawyer:

First,
Trial Director allows the lawyer to exhibit the document in the courtroom to the witness and jury without having to allow time to circulate the exhibit through the panel or making copies for the jury.

Second, Trial Director allows the lawyer to highlight relevant parts of the document while questioning a witness. This allows for a seamless and organized examination whether cross or direct.

Third, Trial Director allows the lawyer rapid access at counsel table to the store of exhibits in order to address issues and arguments that arise in trial.
