Representing debtors and creditors in bankruptcy cases and proceedings, and even serving as a trustee, can give rise to a host of ethical dilemmas and malpractice pitfalls.  This presentation will discuss common problem areas such as clearly identifying who the attorney represents, the timing of the bankruptcy filing, obligations owed to the client and third parties, covering potential exemptions, and handling the automatic stay in debtor-related litigation.  The presenters will provide case examples and offer practical advice on avoiding ethical violations and malpractice claims.
